This car rental contract template is the agreement a rental company hands every renter before the keys change hands. What a Car Rental Contract Template Must Cover

A complete agreement covers eight areas. Each one closes a gap that would otherwise cost you a deposit argument, a chargeback or an unpaid citation.

Renter and vehicle identification

Record the renter's legal name, address, phone, email, date of birth and driver's license number, state and expiry. For the vehicle, record make, model, year, color, VIN, plate and odometer reading at pickup, plus a condition report with timestamped photos. The VIN and plate tie the signed agreement to one specific car when a claim or citation surfaces weeks later.

Rental term and return conditions

State the pickup and return date, time and location. Define the grace period, the hourly or daily charge for a late return, and the point at which an unreturned car counts as unauthorized use. Say how the car must come back: clean, with keys and accessories, no smoking. Your team enforces this clause on every return.

Rates, fees and the security deposit

List the daily or weekly rate, every extra (delivery, child seats, additional drivers, cleaning) and the taxes you collect. Then define the security deposit: when it is held, what it covers (damage, fuel, tolls, cleaning, late fees) and how you document deductions: photos and an itemized statement to the renter. If you advertise in California, the advertised price must include mandatory fees under the state's Honest Pricing Law.

Mileage and fuel policy

Set a daily or total mileage allowance and the per-mile charge above it, or state plainly that mileage is unlimited. For fuel, choose one rule: return at the same level, prepay a full tank, or pay a per-gallon refueling charge. For electric vehicles, set a minimum state of charge instead. Record odometer and fuel at pickup and return.

Insurance and liability

Spell out the coverage the vehicle carries, the coverage the renter must carry, and which policy responds first after an accident. Name any damage waiver you offer, what it costs and what it excludes. Your commercial policy has to match what the agreement promises. Damage, loss and indemnification

This clause connects the condition report to the money. It makes the renter responsible for damage, theft and loss of use during the rental, explains how you assess damage and when you deduct from the deposit versus file a claim. An indemnification line makes the renter cover third-party claims caused by their misuse. Without pickup photos, this clause has nothing to stand on.

Driver eligibility and verification

Set the minimum age, the license requirements (valid, unexpired, held for a minimum period) and how you verify identity before handover. List every authorized driver by name and license number, and state what happens if anyone else drives. Prohibit rideshare and delivery work, towing, racing, off-road driving and leaving the permitted area.

Governing law, tolls and citations, and signatures

Name the state whose law governs the agreement, since deposit-return timelines and disclosure rules vary from state to state. Make the renter responsible for tolls, parking tickets and camera citations during the rental, plus an admin fee per notice. Close with signature and date lines for the renter and your company.
