Car Rental Business License Requirements: The Categories That Apply, and How to Check Your State

What Changes When You Book Directly Instead of Through Turo
On a Turo trip, Turo is the marketplace in the middle. The guest books and pays through Turo, accepts Turo's terms, and the trip falls under Turo's protection plans.
A direct booking has nothing in the middle. The renter signs your agreement, pays your business and drives on your commercial policy, so your business is the rental company. That is when the car rental business license questions become yours: which entity signs, which license covers renting cars for a fee, and which tax applies to the charge.

Business registration and EIN
Choose an entity (sole proprietorship, LLC or corporation), register it with your secretary of state, and get a federal employer identification number. The IRS issues an EIN online and for free, so skip any site that charges. Do it before the direct channel opens, so agreements, bank account and tax accounts all carry the business name.
A general business license
Where one is required, it comes from your city or county, and what you need depends on your activity and address, as the SBA's licensing guide explains. Some cities give rentals their own category. Chicago requires a Limited Business License for vehicle rental or sales, $500 for two years. Search your city's licensing site for vehicle rental before assuming a general license is your car rental business license.
A rental-specific tax or permit
Some states tax vehicle rentals with their own tax, collected from the renter and paid through a state account. In Texas, companies that rent motor vehicles must collect a motor vehicle gross rental receipts tax: 10 percent on contracts of 1 to 30 days and 6.25 percent on 31 to 180 days, per the Texas Comptroller. Nearly every short-term booking sits in the first band. Vehicle titling and registration
Cars bought in your own name stay yours when you form an LLC. Ask your motor vehicle agency whether titles should move into the business, and whether cars rented to the public need a different registration class or plates. If a car is financed, talk to the lender before you retitle it.
Zoning and local permits
This matters if you run a physical lot, office or pickup counter: ask the zoning office whether vehicle rental is allowed at that address. Chicago builds a zoning approval step and a floor plan into its vehicle rental license application. Delivery-only fleets have less to check.
Insurance for direct bookings
Turo's protection plans cover Turo trips only, so direct bookings need your own commercial coverage. The coverage decisions are in the insurance a private rental business needs. If you plan to sell renters an insurance product at checkout, ask your state insurance department whether that takes its own license.
How to Find Your State's Actual Requirements
No single national list of car rental business license requirements exists, and a 50-state table goes stale fast. Work through four offices instead:
- Secretary of state: entity registration and your business name.
- City or county licensing office: the general license, and whether rentals have their own category.
- State revenue department: any rental tax account.
- Motor vehicle agency: titles, registration class and plates.
Check fee rules for advertised prices too. California requires advertised prices to include all mandatory fees.
